Accessing and using the site available at the address www.teampulse.net (hereinafter the "Site") implies the tacit and unconditional acceptance of these terms by the User, under their latest online version.

The "User(s)" are understood in these terms as any natural or legal person connecting to and browsing the Site.

1. DESCRIPTION OF THE SITE

1.1. TEAMPULSE offers on the Site information concerning itself and its service offerings:

• A) Through a mobile application available in iOS and Google Android versions, consisting of a set of features allowing sports team coaches to manage and animate their teams, and players and their possible representatives to communicate with coaches and other members of the teams they belong to, in addition to access to a number of features related to their activity within said teams (hereinafter the "Application Services"),
  
  

• B) On the Site, consisting of a set of features allowing individuals responsible for at least two sports teams, whether structured or not as non-profit sports associations, to manage the administrative, accounting, and financial aspects of such teams (hereinafter the "TeamPulseClub Services").

1.2. Registration on the TEAMPULSE mobile application as a User, and access to and use of the Application Services are subject, among other things, to prior validation of the General Terms of Use and Services of the TEAMPULSE Application.

1.3. Registration on the Site as a Club Administrator and membership and access to the TeamPulseClub Services are subject, among other things, to prior validation of the General Terms of Service TEAMPULSECLUB and the General Terms of Use and Services of the TEAMPULSE Application.

1.4. TEAMPULSE also offers on the Site a distance selling space and delivery of sports equipment and materials (hereinafter the "Products"), some of which can be customized at the client's request, exclusively for individuals, as well as for legal entities acting not on a professional basis, including clubs and sports teams, whether structured or not as non-profit sports associations, provided that these legal entities do not purchase Products other than for their own needs, including corporate gifts, which excludes any operations of purchase for resale.

1.5. Placing an order for Products on the Site is subject to the prior and free creation of a TEAMPULSE User Profile, either through the Site or on the TEAMPULSE mobile application, and to the validation of these General Terms of Sale, the General Terms of Use and Services of the TEAMPULSE Application and these General Terms of Use of the Site, which are validated by Users of the Site solely by their connection to and navigation on the Site.

1.6. For any questions regarding the Products and Services offered by TEAMPULSE, Users are invited to contact customer service at the coordinates listed under Article 5 of these Terms.

2. ACCESS AND AVAILABILITY

2.1. Access to the Site is free and ensured continuously and permanently, except in cases of force majeure or events beyond the control of the Publisher, and subject to any potential breakdowns and technical interventions, maintenance, and updates necessary for the proper functioning of the Site.

2.2. Furthermore, due to the very nature of the Internet, the Publisher cannot guarantee continuous operation of the site 24 hours a day, 7 days a week.

3. LIABILITY

3.1. TEAMPULSE strives to offer Users the most reliable and high-quality information possible on the Site, but does not guarantee the accuracy, timeliness, and completeness of this information, nor its conformity with the intended use of Users.

3.2. Consequently, Users acknowledge that they use this information at their own exclusive risk.
The Publisher cannot be held liable for direct or indirect damages suffered by Users or third parties arising from information disseminated on the Site, and more generally, from the consultation and use of the Site.

3.3. The Publisher does not oversee websites linked to the Site via hyperlinks and disclaims any liability related to such websites and their contents.

4. INTELLECTUAL PROPERTY

4.1. All data of any kind, including texts, graphics, logos, icons, images, photographs, audio or video clips, trademarks, software, and features of the Site appearing on the Site are necessarily protected by copyright, trademark rights, and all other intellectual property rights, and belong to the Publisher or to third parties who have authorized the Publisher to exploit them.
Any reproduction and/or representation of any kind, without permission, of any data referred to in this article constitutes an infringement and will be subject to prosecution.

4.2. The Publisher, as the Site's publisher, grants the User a private, non-collective, and non-exclusive right to use the data referred to in Article 4.1 of these Terms.
The User agrees not to reproduce, summarize, modify, alter, or redistribute, without the prior express permission of the Publisher, any text, title, application, software, logo, image, graphic charter, trademark, information, or illustration for purposes other than strictly private use, which excludes any representation for commercial purposes or for broadcasting in bulk.

4.3. Any creation of a hyperlink from an Internet site to the Site must be subject to the express and prior permission of the Publisher, which can be revoked at any time without justification.

6. CONFIDENTIALITY AND PERSONAL DATA

6.1. TEAMPULSE collects and processes personal data from Users in compliance with the legal requirements of the Data Protection Act of January 6, 1978 and the Regulation (EU) 2016/679 of April 27, 2016 on data protection (GDPR).

6.2. The purposes, recipients, retention periods, and conditions under which the Publisher collects and processes personal data, as well as the rights of the individuals concerned in connection with these processes are precisely detailed in the "Data Protection and Cookie Management Policy of TEAMPULSE"

7. MISCELLANEOUS

7.1. These terms express the entirety of the obligations of the Publisher as well as of the User.
TEAMPULSE reserves the right to unilaterally modify the terms of these Conditions, particularly in the event of technical, legal, or jurisprudential developments, or when new services are implemented.
It is therefore advisable for the User to regularly refer to the latest version of the General Terms of Use available permanently via the link "General Terms of Use" of the Site.
The new clauses will govern all future relations between the parties, and only the new version will be deemed valid between them, the applicable terms being those always accessible online on the Site.

7.2. In the event that any provision of these terms is deemed null under a current or future legal or regulatory provision, or a court decision with the authority of res judicata from a competent court or organization, this provision of the contract shall be considered void, while all other provisions of these terms shall remain binding between the parties.

7.3. In the event of a dispute, only the French version of these General Terms of Use shall be authoritative for interpretation.
These terms are governed by French law for both substantive and procedural rules.
Any dispute arising from the execution or interpretation of the provisions of this contract obliges the parties to come together and attempt to find an amicable solution to their dispute before resorting to the competent jurisdiction.
